Lawyer Prof. OC Kaligis sent a letter to President Prabowo Subianto regarding his money saved in the Jiwasraya insurance Protection Plan program amounting to IDR 35 billion even though it already has permanent legal force.
Kaligis in Jakarta, Monday, said that his party had filed a debt law at the Central Jakarta District Court and won but was still not paid by Jiwasraya.
“President Prabowo in an oath on October 20, 2024, said that he would carry out his duties as well as possible, as honestly as possible, uphold the Constitution and all laws and regulations and serve the country,” said Kaligis.
According to him, the oath was based on Article 9 of the 1945 Constitution that the president as the holder of state office will obey the law, obey the law and obey court decisions.
Meanwhile, court decision no. 219/Pdt.G/2020/PN.Jkt/Pst at the Central Jakarta District Court level and the decision at the DKI Jakarta High Court level no.176/Pdt/2022/PT. DKI and the decision of the Supreme Court of the Republic of Indonesia no. 96 PK/Pdt/2024, but still ignored.
According to him, the legal struggle to collect money stored in Jiwasraya since 2018 has been fruitless, even though the District Court to the Supreme Court have ruled in his favor.
However, for this case, the Central Jakarta District Court has summoned Jiwasraya and the Minister of SOEs, Erick Thohir to carry out the court’s decision but has still been ignored.
To fight for this problem, Kaligis has also sent 20 letters to President Joko Widodo, including to the Chief of Police, Attorney General, Minister of Finance and the Indonesian House of Representatives and Regional Representatives Council of the Republic of Indonesia but there has been no serious response.
In the summons to court, Erick Thohir always failed to attend and only Jiwasraya’s attorney was present.
Sending a letter to President Prabowo to his home address on Jalan Kartanegara No. 4, Kebayoran Baru, South Jakarta with the hope that there will be attention in fighting for justice with other Jiwasraya victims.
He added that the money amounting to Rp 35 billion was the result of hard work and savings as a lawyer since 1966.
Kaligis hopes that President Prabowo will obey the law including respecting court decisions that have permanent legal force, so that he is willing to pay the money.
